election of remedies - a choice made by a party injured by a breach of contract concerning the relief to be sought. The choice of one method of recovery will usually preclude any alternative. For example, in a breach of a real estate contract by a buyer, the seller will usually be required to choose between an action for money (damages) or an action for specific performance (forcing the buyer to purchase the property on the contract terms).
