eminent domain - the right to take private property against the wishes of a property owner for public uses. While the power generally rests with public agencies, such as city and state governments, it may be delegated to private parties authorized to act for the public interest. The exercise of eminent domain requires fair compensation to the property owner. See also condemnation .
