mineral rights - the right to mine, pump, or extract minerals, petroleum, or other substances with or without the right to enter the surface of a particular property. Mineral rights are most often found as a reservation from the granting clause of a deed for the benefit of the grantor. Mineral rights may have been reserved many ownerships earlier, but an examination of title may be undertaken to discover whether there may be a right of the owner of the mineral rights to enter the subject property from its surface to mine or extract minerals, or whether such a mineral right has been judicially construed as an easement, which, if not used for a period of time, is deemed to have expired or been abandoned. Competent legal and title advice is critical to this exploration.
