patent defect - (1) a flaw or defect in real or personal property subject to a sale that is plainly visible or easily discoverable by a reasonable person using ordinary care: a missing roof on a house, for example. See, by contrast, latent defect. (2) a defect in a legal description that cannot be corrected without recording a new description.
