Real Estate Definition - express agency

express agency - an agreement by one person (the agent) to act on behalf of another (the principal) that is intentionally entered into by both the principal and the agent. Express agency is often evidenced by a written agreement. In modern real estate practice and under most state laws, a real estate broker or agent obtains a signed agency agreement from a principal before performing any acts on his or her behalf.
